MINUTES OF THE
MEETING OF THE BOARD OF DIRECTORS OF
WILLIAMSBURG SETTLEMENT MAINTENANCE ASSOCIATION, INC.
JUNE 18, 2013
A meeting of the Board of Directors of the Williamsburg Settlement Maintenance Association, Inc. was held on Tuesday, June 18, 2013 at 5:30 p.m. at the Williamsburg Settlement clubhouse, 1602 Hoyt, Katy, Texas 77449.  

ATTENDANCE

Board Members present were Floyd Ball, Gail Owen, Walt Smith and Larry Crain.  Also, in attendance were Officer Wayne Felchak and Dolores Sue representing Planned Community Management, Inc. (PCMI).

With a quorum being established, the meeting was called to order at 5:30 p.m. 

MINUTES

The Board reviewed the minutes of the May 21, 2013 Board meeting.  A motion to accept the minutes as written was made by Walt Smith, seconded by Gail Owen and unanimously approved. 

HOMEOWNER CONCERNS

There were three (3) homeowners present.

A resident stated there is a rat problem in the subdivision.  He has seen rats in his yard and believes it is a neighborhood-wide problem.  He asked for assistance from the Board of Directors.  It was suggested that an article be put in the newsletter and on the web site advising homeowners to keep grass cut and remove all food that might attract them. This resident felt that this would not be enough and needed more action. The Board will instruct PCMI to investigate the possibilities. 

PATROL SERVICE REPORT

The patrol report was presented. 
     
FINANCIAL AND DELINQUENCY SUMMARY

Floyd Ball presented the financials. As of May 31, 2013, the money in the bank totaled $736,026.56. This includes checking, savings accounts and CD’s and is the money to cover both operating expenses and the necessary reserve to fund maintenance and replacement of the Association’s capital assets.

Delinquency for the month ending May 31, 2013 totaled $ 26,131.35.  In the past two (2) weeks that number has dropped to $24,540.23.

OLD BUSINESS

Perimeter Fence - Floyd Ball informed the meeting that a small work force has recently repaired fences along Colonial Parkway. There is some along the Creek requiring repair in the short term.

NEW BUSINESS

2012 Audit - The Board reviewed the completed 2012 audit.  The report concluded that the financials were presented fairly and in accordance with accounting principles accepted in the United States.

Air Conditioning at the Clubhouse - Floyd Ball explained the air conditioner needs to be checked for the summer to make sure it is in good operating condition.

Dishwasher in Clubhouse - Floyd Ball reported the dishwasher is clogged.  He reported he will be cleaning it out Wednesday, June 19, 2012.

Speed Humps in the Neighborhood - The Board stated that in response from a recent request from a resident it had contacted the office of Steve Radack, the Harris County Commissioner, to obtain the County’s current position regarding speed humps in the subdivision.  The Association received correspondence from the County informing it that Harris County has adopted a policy that no speed bumps or humps will be installed in neighborhoods in unincorporated Harris County or on streets maintained by Harris County. The reason cited was that the County Attorney advised that such speed restricting devices could pose a potential liability to the County.  Until the issue of liability is resolved, Commissioner’s Court will not rescind the policy.

Private Streets  - Floyd Ball explained that some residents had requested information about having the streets in Williamsburg Settlement become private turning the subdivision into a gated community.  The County was contacted. There are steps involved to accomplish this task.  The subdivision would be responsible for the drainage system, street and gutter repairs, a replat would have to completed and every lien holder and homeowners would have to sign off agreeing to have the streets private.

At this time the Board thanked the residents for attending the meeting.

ADJOURNMENT TO EXECUTIVE SESSION

At 5:55 p.m. the Board adjourned to executive session to discuss delinquencies and deed restriction matters.

DECISIONS MADE DURING EXECUTIVE SESSION

Delinquency - The Board reviewed the delinquency report.  Any resident who is not making payments either has been or will be sent a Demand Letter as needed and referred to the Association attorney for collection in accordance with our Collection Policy as posted on the Governing Documents page of the Williamsburg Settlement Website.

Deed Restrictions - The Board reviewed violations for the month of June. It was unanimously agreed to turn two (2) accounts over to the Association attorney for non-compliance.

With no further business the meeting was adjourned at 6:30 p.m. The next meeting will be July 16, 2013
